Hooping.org keeps a directory of already-claimed names.
You can check it here:
http://www.hooping.org/archives/001258.html

and you can also register it there for zero $$$.

There is no "law" about using a name that someone else is using, but most hoopers will be polite and try not to.

Thank you for helping those of us who have started businesses in the Hooping Industry. Some of us have been challenged by others claiming the right to take over a name. According to the legal firm that represents me, "The use of a Trademark/Name is the property of the first user." For many of us it is easy to identify who is the first user from Tribe and Myspace websites as well as dozens of assorted other ways such as publicity in publications.

For those unsure of their names, Hooping.org magazine is a very useful tool to regulate names already being used in the industry.
